Phoenix City Council approves $10 million to settle water, fatal crash claims

Phoenix will pay $3 million for a fatal crash involving a fire engine in 2019. 

A Phoenix firefighter violated department policy by driving 29 mph over the posted limit. Policy allows up to 10 mph over. 

The engine, with lights and sirens on, was responding to a call near 29th Avenue and Bethany Home Road when a pickup truck turned in front of it. The collision killed the truck driver, along with a woman and baby riding with him. 

The City Council also settled a claim by the Salt River Pima Indian Community for $7 million. The community claimed Phoenix trespassed by installing a water line on property it owns at 67th and Southern avenues.

According to the city, its water department believed it had an easement over the property for the water line that had existed for 17 years,  but no documentation could be found. The settlement allows the line to remain and grants a permanent easement for the line in the future. Relocating the line would have cost approximately $6.5 million
