For years, the Hopi Tribe challenged the use of reclaimed wastewater to make artificial snow at Snowbowl Ski Resort in Flagstaff. After a series of unsuccessful attempts, the state Court of Appeals ruled on Thursday that the tribe had made sufficient allegations that tribal members were suffering a "special injury," which allows the lawsuit to move forward before a judge and jury.

The burden is still on the tribe to make their case. Joining us now is state Rep. Eric Descheenie, a member of the Navajo Tribe and a supporter of the efforts to stop the use of wastewater for snowmaking.
